Unfortunately fixed rate residents do not appear to have received the official letter from CCS detailing their offer.

In order to speed up the process for those wishing to purchase their Freehold and benefit from the Bulk Purchase savings John Morse Solicitors have offered to initiate the process in advance of the CCS documentation.

You will need to write to JMS clearly stating your Names and the Address of the property you wish to purchase the freehold for

Please include a copy of your Deed of Variation as this will help speed up the process. JMS can obtain a copy from the Land Registry if required but this may entail a small additional cost.

If you Lease or Deed of Variation is in you and your partners name please make sure your letter is signed by both of you.

ADDITIONAL INFORMATION

In view of the progress already made, CCS have informed us that they will not be strictly enforcing the 28 day deadline for acceptance of their offer(s). 

However, they are keen that the good progress made to date should continue and therefore we would urge all leaseholders who wish to accept the CCS' offer(s) to complete and submit their forms to John Morse Solicitors within the next 2 weeks.


NEXT STEPS

In our last update on 10th April 2015 we provided a breakdown of the costs associated with each option available to us.

Many of these options included discounted legal fees offered by John Morse Solicitors which in their own words was “in order to assist the residents at a time when they need it.“

These discounts will be of great help to all residents and leaseholders.

For those who are considering the offer from CCS of Deferred Payments John Morse Solicitors have also offered to cap their fees at £100.

Please find below the steps you need to take and what will happen depending on the choice you make.


To Accept the £400 Ground Rent
Please Follow These Steps

  1. Write to John Morse Solicitors (JMS) giving them your Name/s and Full Address and details of your lender if applicable, confirming that you want to accept the revised ground rent at £400

  1. JMS will contact the City and County of Swansea with your details.
JMS will then write to you and confirm when this has been done.

  1. City and County of Swansea will prepare all the paperwork and return it to JMS

  1. JMS will review it and arrange for you to sign the Deed of Variation.

  1. JMS with your assistance will deal with any mortgage lenders considerations.  Any monies required will be requested from you and you need to forward these to JMS

  1. Completion to take place.

  1. JMS will make application to the Land Registry to register the Variation.

  1. Completion of registration and notice will be given to you.

To Purchase Your Freehold
Please Follow These Steps

  1. Enter on the “Tenant Notice of Claim to Acquire the Freehold”
a) The address of your house,
b) The rent that was charged per annum until 1st April 2014 at point 5 on the notice.
c) Sign the form.

  1. Send this to John Morse Solicitors (JMS) along with details of how you will be funding the purchase of your Freehold and if applicable your mortgage lenders information. 
Please confirm that JMS may complete the rest of the notice on your behalf and can submit it to the Council.

  1. JMS will then complete the remaining information on the “Tenant Notice of Claim to Acquire the Freehold” form and send it to the City and County of Swansea. 
JMS will then write to you and confirm when this has been done.

  1. City and County of Swansea will prepare all the paperwork and return it to JMS

  1. JMS will review it and arrange for you (the Leaseholder) to sign the same.

  1. You will then forward monies to JMS or JMS will request monies from your mortgage lender (if applicable)

  1. Completion to take place – At this stage you will now own the freehold.

  1. Signed paperwork received from Council.

  1. JMS will make the application to the Land Registry to complete the transaction.

  1. Completion of registration and notice given to you to confirm this.
